Terms of Use

These terms govern your use of the Whispa macOS application (the "App") and the getwhispa.com website (the "Site"), operated by Business Whispa LLC ("we", "us"). By downloading or using the App, or using the Site, you agree to these terms.

1. The App

Whispa is a voice dictation utility for macOS. While you hold a hotkey, it records audio, sends it to a third-party transcription service (OpenAI or Deepgram) to convert it to text, optionally applies an AI cleanup pass, and types the result at your cursor. The App requires macOS 13 or later, a working microphone, an internet connection for transcription, and the macOS Microphone and Accessibility permissions, which it requests transparently and uses only for the functions described on the Site.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Macs you own or control, for personal or internal business purposes. You may not reverse engineer, decompile, modify, resell, redistribute, or bundle the App with other software, except where applicable law permits despite this restriction.

3. Price and changes to the service

The App is currently offered free of charge. We may modify the App, add or remove features, introduce paid plans or features, or suspend or discontinue the App or the Site, in whole or in part, at any time. Nothing in these terms obligates us to provide the App, updates, or support for any particular period.

4. Acceptable use

You agree to use the App only for lawful purposes and not to use it to record any person without consent where consent is required, to interfere with or abuse the transcription services it relies on, or to attempt to circumvent any technical limitation of the App.

5. Third-party services

Transcription is performed by third-party providers under their own terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services, and the App's functionality depends on them.

6. Accuracy

Speech-to-text output may contain errors. You are responsible for reviewing transcribed text before relying on it or sending it — especially in professional, medical, legal, or financial contexts.

7. Intellectual property

The App, the Site, and all related branding and content are owned by us or our licensors. The text you dictate is yours; we claim no rights to it.

8. Disclaimer of warranties

THE APP AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRANSCRIPTIONS WILL BE ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR THE SITE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH, FOR A FREE APP, MAY BE ZERO). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Privacy

Our Privacy Policy explains how information is handled and forms part of these terms.

11. Termination

You can stop using the App at any time by deleting it — uninstalling is as simple as moving it to the Trash. We may terminate or suspend this license if you breach these terms.

12. Changes to these terms

We may update these terms from time to time. The current version will always be posted here with its effective date; continued use of the App or Site after changes means you accept them.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, and disputes shall be resolved in the courts of the State of Delaware, United States.
